These terms and conditions will apply to the Course booked by the Client with Gatwick Fire. Definitions;
"Gatwick Fire" is the Approved Training Provider operating under the control of the Airport Fire Service, Gatwick Airport Ltd, which is the provider of training services under these terms and conditions.
"The Client" means the party that has requested that Gatwick Fire provide the agreed training services
"The Course" means the relevant training course provided by Gatwick Fire.
Gatwick Fire will provide training in accordance with the Course booked by the Client. The content of the Course and training will be as specified in the relevant Course material issued by Gatwick Fire.
Courses may be booked by the Client through the Gatwick Fire booking facility. On receipt of a request for a course booking and subject to the availability of the Course and places thereon, Gatwick Fire will confirm within a reasonable period of time the Course booking, including the dates when the Course will be provided and the number of client delegates who will attend the Course. Within a reasonable period of time thereafter, the Client will confirm the names of delegates who will be attending the Course and complete any pre course administration.
The fees quoted exclude VAT which is payable by the Client.
Unless otherwise agreed, Gatwick Fire will not provide delegates with personal protective clothing.
An invoice will be forwarded to the Client upon commencement of a course and payment will be made by the Client 30 days from invoice date.
Payment should be made in full to Gatwick Fire, 4 weeks prior to the commencement of the period of training. Therefore the attached invoice should be given your immediate attention. NOTE: Delegates who present themselves to Gatwick Fire without payment of course fees will not be allowed admission to training courses or accommodation.
The Client may cancel any Course if 30 or more days' notice is given in writing to Gatwick Fire prior to its commencement. If between 14 and 30 days' notice is given in writing, 50% of the course fees will be payable by the Client. If less than 14 days notice is given, full Course fees will remain payable.
As part of the Course, delegates may require access to the airside environment at Gatwick Airport. Under Department for Transport Regulations, any personnel wishing to enter the airside environment is required to have an approved security pass. As part of the issuing process of a security pass for Courses of more than a two week duration, a reference check will be conducted for the nominated delegate/s. If a delegate/s is/are unable to be granted a security pass as a result of a reference check then they will not be allowed to participate in the course. If this is the case, then the Client is liable for the full cost of the Course.
References of employment or for students, references of education covering the previous 12 month period, from date of application must be submitted before a temporary Airside Security Pass can be issued. This must include any breaks in employment or education.
Unless otherwise specified by Gatwick Fire, on successful completion of the Course, the delegate will be awarded a certificate . The decision of Gatwick Fire as to whether or not a delegate has successfully completed the Course shall be final and conclusive.
Gatwick Fire will arrange such third party liability and indemnity insurance as it considers appropriate and will permit the Client to inspect the relevant policies on reasonable notice and subject to payment of any reasonable administration charges which is considered appropriate.
Either party may forthwith terminate this agreement by notice in writing if:
The other party is in breach of this agreement and fails to remedy such breach within 14 days of written notice unless the breach is not remediable, when this agreement may be terminated forthwith (unless the non-remediable breach is trivial);
The other party goes into liquidation or is made bankrupt, a receiver is appointed over any of its assets or business or an Administrator of the Client is appointed or it passes a resolution for voluntary liquidation (other than as part of a bone fide scheme of amalgamation or reconstruction).
Termination of this agreement shall be without prejudice to any accrued rights or remedies to either party.
If the UK Civil Aviation Authority requirement for mandatory aviation fire training at an approved fire training school is revised or withdrawn. Unusual circumstances
Gatwick Fire shall not be liable for non-performance or delay of performance which is due to any cause beyond its reasonable control including (without limitation) inclement weather, fire, flood, industrial action, explosions, government regulations and orders and acts of God. Amendments
No amendments to this agreement shall be valid unless they have been made in writing and executed by duly authorised of managers of both parties.
Gatwick Fire is less than 30 minutes from central London and course accommodation is provided
by Hilton Gatwick South Terminal.
